This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of respondents in illegally interfering with the peaceful possession and enjoyment of the petitioner over the lands admeasuring Ac.0-29 guntas and Ac.0-11 guntas in Survey No.3268/ A, situated at Government Girraj College, Nizamabad Shivar, Nizamabad, and thereby, trying to dispossess the petitioner from the subject lands, as illegal and arbitrary and consequently, to direct the respondents not to interfere and dispossess the petitioner from the subject lands.

Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue, appearing for the respondents. Perused the record.

Learned Assistant Government Pleader for Revenue, on written instructions, dated 07.05.2019, would submit that no interference is made by the Government in respect of the subject lands; that an enquiry is being conducted with regard to mutation in respect of the subject lands; that the petitioner was called upon by respondent No.3/ Tahsildar, Nizamabad Mandal, vide notices bearing Nos.A5/ 1614/ 2018, dated 08.10.2018, 28.12.2018 and 22.01.2019, to appear and submit documents in

support of his claim; that in spite of the same, the petitioner has not turned out to make submissions.

In view of the submissions made, the petitioner has to agitate his grievance before respondent No.3/ Tahsildar, Nizamabad Mandal, pursuant to the aforementioned notices. Noting survives in this Writ Petition to grant any relief in favour of the petitioner.

With the above observation, the Writ Petition is dismissed. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. ______________________ Dr . SHAMEEM AKTHER, J May 08, 2019.
