HONOURABLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.10387 OF 2007 ORDER:

The writ petition is filed questioning the action of the 1st respondent-M.R.O in issuing notices dated 28.4.2007 in Form-2 under Rule 3 of Rules made under the A.P. Assigned Lands (Prohibition of Transfers) Act, 1977 (for short, "the Act"), in respect of lands admeasuring Acs.2.00 cents and Ac.0.83 cents in Sy.Nos.523-ID and 523-1C respectively situated at Pitapuram Village and Mandal, East Godavari District, belonging to the petitioner, as arbitrary and illegal.

Today, when the matter came up for hearing, learned counsel for the petitioner filed a memo stating that the notices dated 28.04.2007 were issued by the 1st respondent-M.R.O, under the premise that the subject lands belonged to A.P. Bhoodan Yagna Board. However, during the pendency of the present writ petition, a Gazette Notification, dated 04.09.2008, was issued denotifiying the subject lands and deleting the said lands from the list of Bhoodan lands. In view of the Gazette Notification issued by the Government denotifing the subject lands belonging to the petitioner, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty to the petitioner to question any further action if at all initiated by the respondents in respect of the subject lands.

In the facts and circumstances of the case and in view of the memo filed by the petitioner seeking withdrawal of the writ petition, the writ petition is dismissed as withdrawn giving liberty

to question any further action, if at all initiated by the respondents in respect of the subject lands. No order as to costs. Miscellaneous petitions pending if any, in the writ petition shall stand closed.
