HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 30937 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents. The petitioner was appointed as fair price shop dealer of shop No.23 of Pedda Kopperla village, Koilkuntla Mandal, Kurnool District. The shop of the petitioner was inspected by the 4th respondent on 12.08.2015 and he submitted report to the 2nd respondent on 13.08.2015.

Based on the same, an order of suspension was passed by the 2nd respondent on 24.08.2015 pursuant to the inspection conducted on 12.08.2015. Nothing prevented the 2nd respondent from proceeding with the enquiry, if such an order was passed on 24.08.2015 pursuant to the inspection conducted on 12.08.2015. He cannot keep the enquiry pending after passing the order of suspension. The action of 2nd respondent is arbitrary. However, in view of the pendency of enquiry, this Court is not inclined to entertain the present writ petition.

In the circumstances, the 2nd respondent is directed to issue appropriate show cause notice to the petitioner, invite his explanation and conduct enquiry by giving due

opportunity of hearing the petitioner and pass final orders thereon within a period of sixty days from the date of receipt of a copy of this order.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed.
