HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4839 of 2015 O R D E R:
This petition is filed by the petitioners/A.1 and A.2 under Sections 437 and 439 of the Criminal Procedure Code seeking to grant bail to them in P.R.C.No.22 of 2012 on the file of the IV Additional Judicial Magistrate of First Class, Kakinada, registered for the offences under Section 323 read with Section 34 IPC and Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Heard and perused the material available on record. It is submitted by the learned counsel for the petitioners submits that originally the petitioners were granted bail and subsequently, they could not able to appear before the Court due to lack of communication between the petitioners and their counsel and as such, Non Bailable Warrants are issued in the month of July, 2013 itself. The petitioners were arrested on 19.02.2015 and since then, they have been in prison.
Considering the above facts and circumstances of the case and taking into consideration the fact that the petitioners have been in jail since 19.02.2015, this Court is inclined to grant bail to the petitioners. The petitioners shall be enlarged on bail on condition of their executing personal bonds for a sum of Rs.5,000/- (Rupees five thousand only) each with two sureties each for the like sum each to the satisfaction of the IV Additional Judicial Magistrate of First Class, Kakinada. The petitioners are directed to appear before the Committal Court whenever the case is posted.
