THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No. 8006 of 2017 ORDER:

This writ petition is filed questioning the order, dated Nil.05.2016, passed by the 3rd respondent cancelling the fair price shop authorization of the petitioner in respect of shop No.10 of Nizampet Village, Quthbullapur Mandal, Medchal District.

Heard learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

By way of the order under challenge, the Special Grade Deputy Collector and Revenue Divisional Officer, Malkajgiri Division, 3rd respondent, cancelled the authorization of the petitioner while tagging on food security cards of subject shop to shop No.28. Aggrieved by the said order of cancellation, the petitioner preferred an appeal on 26.07.2016 under clause 20(2) of the A.P. State Public Distribution System Control Order, 2008. Along with the said appeal, the petitioner also filed stay application praying for suspension of the order of cancellation and the said appeal is pending for consideration before the 2nd respondent.

Learned counsel for the petitioner submits that though the appeal was filed long back, no orders have been passed so far either on the appeal or on the stay application and in view of the same the petitioner is being put to lot of hardship and irreparable loss.

Having heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies, this Court is of the considered opinion that the ends of justice would be served if the 2nd respondent is directed to pass appropriate orders on the appeal said to have been filed by the petitioner on 26.07.2016 against the order of cancellation, dated Nil.05.2016, within a period of

six weeks from the date of receipt of a copy of this order. If no orders are passed within the time stipulated above, the petitioner is entitled to lift the stock. Accordingly, writ petition is disposed of.

Miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
