THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.10242 OF 2019 ORDER: {Per the Hon'ble Sri Justice P.Naveen Rao} The petitioner claims to be in possession of land to an extent of Ac.0.30 gts in Survey No.55/E5 situated at Sangapur Village, Gajwel Mandal, Siddipet District and an extent of Ac.0.25 gts in Survey No.560/1 situated at Gajwel Village and Mandal, Siddipet District. The petitioner further claims that having purchased the subject land thirty years ago, he has constructed poultry farm and also dairy farm in Survey No.560/1. The petitioner now apprehends that the respondents are trying to dispossess the petitioner from the above extent of land without following due process of law.
According to the learned counsel for the petitioner, survey was conducted on the adjacent lands and also in the lands of the petitioner and the petitioner was informed that he would be dispossessed from the entire extent of land in his possession. Learned counsel, therefore, submits that such action of the respondents is illegal. No person can be dispossessed from the land owned by him without following due process even if the land is required for public purpose.
Learned Special Government Pleader submits that so far no notification is issued to acquire the land, which is claimed to be in possession of the petitioner and if at all said land is required, they would follow due process. He further submits that an application was made on 15.10.2017 for regularization of land to an extent of
Ac.30 gts in Survey No.560/1 situated at Gajwel Village & Mandal, Siddipet District, as if the petitioner is in occupation of Government land but the same was rejected by order dated 08.01.2018, which was challenged in W.P.No.2615 of 2019 and the same is pending consideration by this Court. However, he fairly submits that no proceedings are set in motion and if at all the land claimed to be in the possession of petitioner is required or for any other reason, the Government would verify possessory claim and if found in possession would follow due process before dispossessing the petitioner.
Recording the same, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous applications, if any, pending shall stand closed.
