THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9246 OF 2016 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/accused seeking anticipatory bail in crime No.294 of 2016 on the file of the P.S., Neredmet, registered for the offences under Sections 8 and 12 of the POCSO Act. Heard and perused.

The case of the prosecution is that the petitioner, who is serving as Pastor in a Church, physically abused the minor child while the child was in the house of the petitioner by placing hands over the body of the child and the petitioner used to show to minor child pornographic movies.

Learned counsel for the petitioner submits that the petitioner has not committed any offence and that the petitioner is a Pastor and he is a law abiding citizen. He further submits that the petitioner has been falsely implicated in the present case and as such prays this Court to grant anticipatory bail to the petitioner herein. Originally the case is registered for the offences under Sections 8 and 12 of the POCSO Act and subsequently, altered to Section 376 IPC. Taking into consideration of the Statement under Section 164 CrPC., this Court is not inclined to grant anticipatory bail to the petitioner.
