THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.8767 of 2018 ORDER:
It is the case of the petitioner that she was issued a house site patta in respect of the land of an extent of Ac.0.05 cents in Survey No.138 of Konapur Village, Kodimial Mandal, Karimnagar District, on 19.12.1995. Along with her, 55 other persons were also assigned house site pattas and the colony is called, Beedi Workers Colony. Since there was no water in the underground, they did not construct houses. Later in view of the availability of water due to Mission Bhagiratha, when they wanted to construct houses, it was interfered by the respondents. In those circumstances, they filed W.P.No.18040 of 2017 and the said Writ Petition was disposed of on 07.06.2017 directing the respondents to follow the due process of law. Accordingly, the third respondent issued a show cause notice on 31.07.2017 and the petitioner submitted her explanation on 02.08.2017. Now, it is alleged that respondent Nos.3 and 4 are interfering with her possession over the land without passing any final order. In those circumstances, the present Writ Petition is filed.
Since neither a final order was passed nor was it communicated to the petitioner, the land belonging to the petitioner shall not be interfered by respondent Nos.3 and 4 without passing the final order and communicating the same to the petitioner. If the said order is adverse to the interest of the
petitioner, the same shall not be implemented for a period of thirty days in order to enable the petitioner to take appropriate steps against the said order.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 16.03.2018 vs
