Sri Vinayaka Timber Depot v. Canara Bank,
THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION NO.12926 OF 2016
O R D E R
(per Hon'ble Sri Justice Sanjay Kumar) Challenge in this writ petition was to the sale notice issued by the respondent bank proposing to hold the sale on 25.05.2016. Interim stay of confirmation of the sale was granted by this Court subject to certain conditions.
It is however represented by Sri S.Lakshmikanth, learned counsel representing Sri Deepak Bhattacharjee, learned counsel for the respondent bank, that the sale did not materialize on 25.05.2016. The learned counsel further states that the conditional interim order passed by this Court was not even complied with.
In that view of the matter, the cause in this writ petition is rendered purely academic and does not warrant consideration on merits. The writ petition is accordingly dismissed leaving all issues open. Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
