HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 10244 OF 2019 O R D E R :

This writ petition is filed challenging the action of the 3rd respondent in seizing the vehicle of the petitioner Hyundai 120 Car, bearing No.TS 09EG 8432, while registering a Crime against the petitioner vide FIR No.164/2019, dt.30.03.2019. Learned Counsel for the petitioner states that the petitioner has submitted application on 09.05.2019 before the impleaded 4th respondent-Deputy Commissioner of Prohibition & Excise, Karimnagar, for release of the vehicle, but no order is passed, till date. He also submits that the respondent police have illegally seized the vehicle when the petitioner was transporting liquor purchased for the purpose of marriage function.

He further submits that after seizure of the vehicle, the 3rd respondent had not produced the said vehicle before the Deputy Commissioner of Prohibition and Excise, immediately; that the vehicle is lying idle for the last two months without any use; and that if the same is allowed the vehicle would be of no use and it would not be roadworthy.

Accordingly, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
