THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9473 OF 2017 ORDER:
Heard learned counsel for the petitioner/A1 of Crime No.58 of 2017, pending on the file of Pedanandipadu Police Station, Guntur District, registered for the offences punishable under Sections 376, 420, 419, 506, 509 r/w 34 IPC and learned public prosecutor, representing the 1st respondent - State, before ordering notice to 2nd respondent - defacto complainant and perused the grounds urged in the quash petition and the contents of the FIR.

On perusal of the entire material on record, it is premature for this Court to make any expression as to Section 376 IPC applies or not, so far as the petitioner/A1 concerned, even this Court earlier observed, so far as other accused not come within the purview of Section 376 IPC, thus, there is nothing to admit the application, much less, to pass any order by interdicting the investigation. 3.
Accordingly and with the above direction, this criminal petition is disposed of, by left open all available remedies to the petitioner.
