THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO Criminal Petition No.7258 of 2017 ORDER :

Heard the learned counsel for the petitioner/ accused of Cr.No.65 of 2017 of Sydapruam Police Station registered for the offences punishable u/ sec.3(1) ® and (s) of the Scheduled Castes and Scheduled Tribes(Prevention Of Atrocities) Act. The absence of 2nd respondent despite notice served taken as heard and also the heard learned Public Prosecutor for the 1st respondent-State and perused the grounds urged in the quash petition contents of the First Information Report and other material on record including the interim order of this Court,dt.23.08.2017 which reads as follows:- " There is nothing to interfere with the investigation. However, from the material on record, there shall be stay of arrest for a period of four weeks" .

From perusal of the material on record as observed in the interim order supra, there is nothing to interfere with the investigation but for the petitioner shall not be arrested pending investigation however it will not prevent the police to secure the presence of the petitioner for the purpose of investigation as and when required. All the defences are left open to the petitioner. Having regard to the above, the Criminal Petition is disposed of. Consequently, pending miscellaneous petitions, if any, shall stand closed.
