28.04.2025 JSR, J I.A.Nos.3 and 4 of 2025 These two applications are filed seeking to Transferred to i/o folder, before corrections, if any modify the condition imposed by this Court in respect of execution of personal bond for a sum of Rs.1,00,000/- to Rs.50,000/- and to extend the time for surrender, respectively.
Heard Mr. Goverdhan Venu, learned counsel representing Mr. A. Raghuram Reddy, learned counsel for the petitioners, Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent No.1 State. No representation on behalf of respondent No.2.
Learned counsel for the petitioners submits that the petitioners have approached this Court and filed Crl.P.No.4574 of 2025 for grant of anticipatory bail in connection with Crime No.224 of 2025 of CCS, DD Team Police Station, Hyderabad. This Court allowed the said criminal petition on 11.04.2025 with certain conditions, viz., the petitioners were directed to surrender before the concerned Station House Officer, CCS, DD Team 5, Hyderabad, on or before 21.04.2025 and on such surrender, the concerned Officer of CCS, DD Team 5, Hyderabad, release the petitioners on bail on their executing a personal bond for a sum of
Rs.1,00,000/- with two sureties for a like sum each to the satisfaction of the said Officer.
He further submits that due to financial difficulties, the petitioners could not execute the personal bond as directed by this Court and due to the same, the petitioners have not surrendered before the Station House Officer, CCS, DD Team 5, Hyderabad, within the stipulated time. Unless the above said condition of execution of personal bond from Rs.1,00,000/- to Rs.50,000/- is reduced and extend the time to surrender, the petitioners will be put to great hardship.
Learned Additional Public Prosecutor has not opposed the same.
In view of the above said submissions and in view of the reasons assigned in the affidavits filed in support of the applications, the order dated 11.04.2025 passed in Crl.P.No.4574 of 2025 is modified to the extent that "(i) The petitioners/accused Nos.1 to 3 are directed to surrender before the Station House Officer, CCS, DD Team 5, Hyderabad, on or before 02.05.2025;
(ii) On such surrender, the Station House Officer, CCS, DD Team 5, Hyderabad, shall release the petitioners on bail on their executing a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for a like such each to the satisfaction of the said Officer;
(iii) On such release, petitioner No.1/accused
No.1 shall appear before the Station House Officer, CCS, DD Team 5, Hyderabad, on 2nd and 4th Sunday of every month, commencing from 04.05.2025; and (iv) On such release, petitioner Nos.2 and 3/accused Nos.2 and 3 shall appear on every Monday commencing from 05.05.2025, for a period of eight weeks for the purpose of investigation, and thereafter, as and when required for investigation."
The other conditions remain unaltered except above. Accordingly, I.A.Nos.3 and 4 of 2025 are ordered.
Registry is directed to issue amended copy of the order.
