This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners, to declare the action of the respondents in not allotting paddy to the petitioners rice mills under 'CMR Rice Scheme' for Kariff season 2019-2020 as illegal, arbitrary, contrary to the paddy procurement scheme and consequently direct the respondents to allot paddy to the petitioners rice mills under 'CMR Rice Scheme' for Kariff season 2019-2020.

Heard the learned counsel for the petitioners, the learned Government Pleader for Civil Supplies appearing for the respondents and perused the record.

It has been submitted by the learned Government Pleader for Civil Supplies appearing for the respondents that Kharif season of the year 2018-2019 ended by February, 2019. The petitioners have not got their names included in the list maintained for allotment of paddy under 'CMR Rice Scheme' for Kharif Season 2018-2019. No representation is submitted by the petitioners for such inclusion.

The learned counsel for the petitioners has fairly conceded that the petitioners have not submitted any application for inclusion of their names in the list maintained for allotment of paddy under 'CMR Rice Scheme' for Kharif Season 2018-2019.

Under these circumstances, the petitioners are granted liberty to submit a representation to the authorities concerned for inclusion of their names in the list maintained for allotment of paddy under 'CMR Rice Scheme' for Kharif Season 2019-2020. In the event of submission of such representation/ s by the petitioners, the authorities concerned may examine the same and pass suitable orders in accordance with the governing regulations.

With the above observation, this Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
