HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.2088 of 2017 ORDER:

Heard learned counsel for the petitioners/accused Nos.1 to 6 of C.C.No.371 of 2016 pending on the file of Additional Judicial Magistrate of First Class at Nirmal, Adilabad District, where the learned Magistrate has taken cognizance for the offence under Section 500 IPC, which is outcome of private complaint of the 2nd respondent-defacto complainant and perused the grounds in the quash petition and the interim order passed by this Court on 06.06.2017 while entertaining this petition.

It is premature to go into the merits of the matter when it requires trial on several factual disputed questions and there is nothing to keep the matter pending to interdict the enquiry in relation to framing of charges if any and trial. Having regard to the above, the Criminal Petition is disposed of by giving liberty to the petitioners by virtue of this order for one to represent others to file application under Rule 37 of Criminal Rules of Practice before the learned Magistrate and the learned Magistrate to permit with condition of personal appearance whenever required.
