THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36297 of 2014 ORDER:

This writ petition under Article 226 of Constitution of India is filed to declare the inaction of the 1st respondent in considering the claim of the petitioner for grant of pension under "Swatantra Sainik Samman Pension Scheme - 1980" deposit verification report sent by the 2nd respondent vide letter No.41969/FF/A3/2003-1, dated 14.10.2003, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioner is that the petitioner is aged about 84 years. The petitioner has participated in the freedom movement during the period of 1947-48 and the then Nizam Government issued arrest warrant on knowing that he went underground and he was under the camp in charge of Kamma Jaggaiahn Mongullu Camp, Nandigama Taluk, Krishna District. It is the further case of the petitioner that he has submitted representation, dated 14.10.

2013, to the Deputy Secretary, Government of India, Ministry of Home Affairs (FF Division), Lok Nayak Bhavan, Kham Market, New Delhi (1st respondent), requesting to consider his application and release the freedom fighter pension to him as he is eligible and entitled for the pension in the above said scheme and that the said representation was received by the 1st respondent also, but so far, no action is taken on the representation. Considering the facts and circumstances of the case and also considering the age of the petitioner, the 1st respondent is directed to consider the representation submitted by the petitioner, dated 14.10.2013, and dispose of the same, as expeditiously as possible, in accordance with law, preferably within a period of six (6) months from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
