Heard both sides and perused the material on record.

2) In view of the specific provision under Order XLIII Rule 1(r) C.P.C of appeal lies, the Registry to return the petition by closing the revision petition and the petitioner to represent the revision as appeal with necessary correction and neat copy.

3) In the result, the civil revision petition is closed. There shall be no order as to costs.

4) Miscellaneous petitions, if any pending, shall stand closed.
