HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4628 of 2017 ORDER:

The Writ Petition is filed alleging inaction of respondent Nos.3 and 4, in preventing respondent No.5 from proceeding with illegal construction over the tank earmarked in Full Tank Level (FTL) area towards east of Plot No.35, forming part of S.No.42, situated at Bandlaguda, Uppal Mandal, Medchal District, as being illegal and arbitrary.

The sum and substance of the allegations is that respondent No.5, apart from encroaching the land of petitioner and others, is making construction unauthorisedly and without any permission being obtained from the authorities concerned and, that too, in the prohibited zone violating FTL norms.

In support of the averments in the Writ Petition, the petitioner filed patta certificate dated 23.05.1985 granted in his favour; and copies of complaint dated 21.09.2016 and 20.05.2016 addressed to Mandal Revenue Officer and Tahsildar, Uppal Mandal, Ranga Reddy District respectively against Smt K.Sandhya W/o.K.Ramesh.

Without expressing any opinion on the merits of the case, the Writ Petition is disposed of directing respondent Nos.3 and 4 to ensure that, if the allegations made by the petitioner are true and correct, respondent No.5 shall not

violate FTL norms and prevent the constructions being made within a period of eight weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
