The writ prayer is completely misconceived. The 2nd petitioner through letter dated 30.05.2012 requested the Sub-Registrar/ 3rd respondent not to entertain the documents presented for registration concerning Sy.Nos.289/1, 289/4 and 290 of Vikruthamala Village, Yerpedu Mandal, Chittoor District. The 3rd respondent through communication dated 30.05.2012, in the opinion of this Court, has rightly informed the 2nd petitioner that on the request of a party, the registration of a document cannot be stopped by the registering authority. It is further stated that if the applicant is interested in obtaining prohibitory orders, the applicant is free to approach the Court having jurisdiction in this behalf. No exception to this communication can be taken either in law or on fact.
If the petitioners see a cause of action or infringement of their right vis-à-vis the subject matter of the writ petition, the petitioners can certainly move the competent Civil Court and obtain appropriate orders protecting their interest.
With the above observation, the writ petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
