HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE Writ Petition No.19828 of 2010 ORDER:

Heard learned counsel for the petitioner. None appeared for the respondents, though served.

Petitioner in the instant writ petition, seeks the following relief: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondent No.3 passing orders in proceedings Rc. No. C/547/2010, dated 4.8.2010, without giving an opportunity and without seeking any explanation is illegal and arbitrary and unconstitutional and pass such other order or further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

On 16.8.2010, while admitting the writ petition, this Court on Miscellaneous Petition No. 25116 of 2010 passed the following order: "Interim Suspension as prayed for.

However, it is made clear that the enquiry may go on, as regards the allegations levelled against the petitioner, and appropriate final orders may be passed thereon in accordance with the A.P. State Public Distribution System (Control) Order, 2008." Learned counsel for the petitioner submits that till today, the enquiry has not been concluded. That being so, I do not find any reason to keep this petition pending any further and it can be disposed of in terms of the interim order.

It is needless to mention that if the outcome of the enquiry is against the petitioner, the order of cancellation of authorization of the petitioner would

stand revived.

With the above directions, the writ petition is disposed of. Consequently, pending miscellaneous applications shall also stand closed. No costs.
