HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.2211 of 2018 Order:

The petitioners have come up with the above revision challenging an ex parte interim order of injunction granted by the Trial Court restraining them from putting up further constructions in Item No.1 of suit 'G' schedule property.

2. Heard Mr. Tarlada Rajasekhar Rao, learned counsel for the petitioners.

3. The order against which the revision is filed, is dated 04-01-2018. It is only an ex parte temporary ad interim order. The application was directed to be posted on 25-01-2018. It is not known as to what happened subsequently. It is not clear whether the petitioners filed a counter and sought the dismissal of the application for injunction.

4. According to the learned counsel for the petitioners, they filed a counter affidavit to the application for injunction and the Court has not taken it up.

5. At this stage, I do not wish to go into the merits of the case when the interlocutory application is not disposed of by the Trial Court. Therefore, the revision is disposed of directing the Trial Court to hear I.A.No.588 of 2017 and dispose of it in accordance with law, on the basis of the rival contentions, within a period of 4 (four) weeks. The applications, if any, pending in this revision shall stand closed. No costs. __________________________ V.RAMASUBRAMANIAN, J.
