THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.3226 of 2020 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A-4 seeking to grant anticipatory bail in the event of his arrest in connection with FIR No.383 of 2019 of SHO, Golconda Police Station, Hyderabad, which was registered for the offences punishable under Sections 147, 365, 386 and 323 of IPC r/w. Section 149 of IPC. Heard learned counsel appearing for the petitioner/A-4, learned Additional Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioner would contend that the petitioner is innocent and has nothing to do with the alleged offences and he was falsely implicated in the above crime. It is also contended that the other accused i.e., A-2, A-3, A-5 and A-7 have already been granted bail. It is further contended that the petitioner is ready to abide by any condition that may be imposed by this Court while granting anticipatory bail to him. On the other hand, the learned Additional Public Prosecutor opposed to grant anticipatory bail to the petitioner/A-4. As seen from the contents of FIR and other material available on record, there are specific allegations levelled against the petitioner alleging that he along with A-1 has forcibly lifted the complainant from foot path, took him in a car to some conspicuous place and assaulted him rigorously, harassed him and took a sum

GSD, J Crl.P.No.3226 of 2020 of Rs.8,500/- and a Jio Phone from him. Thus, keeping in view the nature of allegations, his involvement and the gravity of offences alleged against the petitioner, I am not inclined to grant anticipatory bail to the petitioner/A-4.

However, if the petitioner/A-4 surrenders before the competent Court within a period of two weeks from today and applies for regular bail, the same shall be considered by the said Court, in accordance with law, after giving prior notice to the Public Prosecutor concerned.

Accordingly, this Criminal Petition is disposed of. Miscellaneous applications, if any, pending shall stand closed.
