ORDER

When the matter is taken up for hearing, learned counsel appearing for the petitioner submits that in pursuance of the interim order granted by this Court on 8-12-2006 in WPMP No.32909 of 2006, the petitioner was continued as Assistant Engineer and he retired from service on attaining the age of superannuation during the pendency of the writ petition and hence, the cause in the writ petition does not survive for adjudication.

Recording the said submission, the Writ Petition is dismissed as infructuous. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
