HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.20055 of 2017 ORDER:

Heard learned counsel for the petitioner and also the learned Government Pleader for Civil Supplies representing the respondents and perused the prayer in the writ petition with the supporting affidavit and other material on record. The grievance of the petitioner is that it is ill-motive outcome of inaction to the earlier suspension order dated 18.03.2015 challenged in W.P.No.9221 of 2015, wherein that order was set aside with a direction to conduct enquiry and pass final order, that was not given effect, however with a fresh cause created, the petitioner's license is suspended and the enquiry initiated is unsustainable. Undisputedly he filed his explanation, it is for consideration, suspension pending enquiry since 11.05.

2017 and only one month lapsed therefrom, leave about the legal position pointed out by the learned Government Pleader pending enquiry suspension maximum three months, but for if special circumstances made out by the authorities even beyond that period. Once a final order to be passed, the authorities to be diligent to pass final order. Thereby there is nothing to interfere, but for direction to pass for final order.

Accordingly and in the result, the Writ Petition is disposed of directing the authorities to pass final orders within two (02) months from the date of receipt of a copy of this order. The petitioner is directed to appear before the authorities without fail on 03.07.2017 and they will fix date therefrom and he can submit

Dr. SSRB,J further explanation if any. In the meantime, the respondents shall supply, on acknowledgment, a copy of enquiry report to the petitioner. Any further remedy is left open. Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
