C.M.A.No.528 of 2019 HACJ & Dr. SAJ JUDGMENT: (Per the Hon'ble Dr. Justice Shameem Akther) Heard the learned Senior Counsel Sri A. Sudershan Reddy appearing for the petitioner and the learned Senior Counsel Sri K. G. Krishna Murthy appearing for the respondent, and perused the records.
This Civil Miscellaneous Appeal is filed challenging the ad interim injunction order, dated 03.05.2019, granted by the learned III Additional Chief Judge, City Civil Court, Hyderabad, in Arbitration O.P.No.54 of 2019.
While dealing with this matter, this Court was pleased to grant an interim suspension vide order, dated 22.05.2019. Since the impugned order passed by the Court below, which is sub judice before this Court, is lapsed due to passage of time, nothing survives in this Civil Miscellaneous Appeal for adjudication. Both the parties are at liberty to work out their remedies in the Arbitration O.P.No.54 of 2019 pending on the file of the learned III Additional Chief Judge, City Civil Court, Hyderabad. The learned III Additional Chief Judge, City Civil Court, Hyderabad, is requested to dispose of the interlocutory application as expeditiously as possible, preferably, within a period of two weeks from the date of receipt of a copy of this order.
With the above observations, the Civil Miscellaneous Appeal is, accordingly, dismissed as infructuous.
