Heard learned counsel for petitioners and the Assistant Government Pleader (Revenue) for respondents. The petitioners pray for Mandamus declaring the threatened dispossession of petitioners from the land measuring Ac.0-82 cents, Ac.0.82 cents and Ac.1-84 cents in Sy.No.107/ 2 of Thimmarajupalem Village, Parchur Mandal, Prakasam District, as illegal, arbitrary and unconstitutional.
It is the case of petitioners that aggrieved by the orders of 3rd respondent in Rc.DT/ 99/ 2014 dated 20.02.2018, directing the petitioners to vacate from the lands mentioned above, the petitioners filed appeal under Section 10 of the Land Encroachment Act before the 2nd respondent and the same is pending. Be that as it may, without entering into the merits of the matter, this Court prefers to dispose of the writ petition as under: (a) the 2nd respondent is directed to hear and dispose of the appeal filed by the petitioners within four weeks from the date of receipt of copy of this order; and (b) the parties are directed to maintain status quo as regards physical features and possession as on date till the disposal of the appeal.
The writ petition is, accordingly, disposed of as indicated above. There shall be no order as to costs.
