THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21244 of 2016 ORDER :
Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for respondent No.2. At their request, the Writ Petition is being taken up for disposal at the admission stage. Since this court is not deciding the case on merits, it may not be necessary to hear respondent No.5.
2. The prayer of the petitioner in this case is as under: "...to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents in taking any action against the respondent No.5 who making illegal construction of house in the government land in Sy No.170 situated at Mohammed Qasim Basti, Bellampally Municipality, Adilabad District without any permission and also without leaving setbacks as arbitrary and illegal and also violative of Article 16 of the Constitution of India consequently direct the respondents to take appropriate action against the respondent No.5 basing on the application dated 20.6.2016 or pass..."
3. Today, when the matter is taken up for hearing, it is brought to the notice of this Court that pursuant to the application dated 20.6.2016 made by the petitioner, steps are being taken to issue notice to unofficial respondent No.5 under the relevant provision of law. In that view of the matter, counsel for the petitioner submits that nothing
survives for adjudication in this Writ Petition.
4. The Writ Petition is, accordingly, closed directing the respondent No.2 to take action in accordance with law on the application dated 20.06.2016 at the earliest. It is made clear that notice proposed to be given to unofficial respondent No.5 shall be given at the earliest, preferably within a period of one week from today. Pending miscellaneous petitions, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
