Crl.Petition No.2596 of 2022 HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2596 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioners/Accused Nos.5 and 6 on bail in connection with Crime No.260 of 2021 on the file of Nalgonda Rural Police Station, Nalgonda District registered for the offence punishable under Section 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act') and Section 9 of the NDPS Amendment Act, 2014.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

Briefly the facts of the case are that Accused Nos.1 to 3 are transporting and selling ganja and accordingly, they were arrested and sent to jail.

The allegation against the present petitioners is that they purchased ganja from Accused No.1 and 10. However, learned Public Prosecutor submits that no seizures were effected from the petitioners. He further submits that charge sheet is already filed and the same is numbered.

In the said circumstances, for the reason of there being no seizures apart from the confession of other accused, the petitioners/Accused Nos.5 and 6 can be granted bail subject to the following conditions:

i) The petitioners/Accused Nos.5 and 6 are directed to be released on bail on their executing personal bond for Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for likesum each to the satisfaction of learned Judicial First Class Magistrate at Nalgonda.

ii) The petitioners shall appear before the trial Court on every date of hearing.

iii) During the bail period, the petitioners/Accused Nos.5 and 6 shall not indulge in any crime.

Accordingly, the Criminal Petition is allowed. 8.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
