HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.2125 of 2016 ORDER:

Heard learned counsel for the petitioners and the learned Government Pleader for Revenue.

The 1st petitioner is an association of Fishermen, who are below the poverty line as per the socio economic survey. It is stated that earlier a request was made for allotment of Government land and the list of beneficiaries was finalized wherein 189 persons were stated to be found eligible. While the petitioners request was under consideration, it is stated that the 4th respondent already sent a report in Rc.No.473/2012/C, dated 14-09-2012 to the 3rd respondent making recommendation in favour of the petitioners and the 3rd respondent is stated to have further sent a report to the 2nd respondent and the 2nd respondent is stated to be considering the request of the petitioners. While so, the present writ petition is filed alleging that their representations are pending and no further decision is taken by the 2nd respondent.

Learned Government Pleader for Revenue has received instructions and states that permission for relaxation of the orders issued under G.O.Rt.No.136 Housing (U&IAY), Department, dated 08-05-2006, whereunder the assignment of Government land is banned for individual usage situated within five kilometres from GVMC, is necessarily to be granted by the Government. It is also stated that unauthorized encroachers were already removed on 02-11-2015 and the land admeasuring Ac.2-03 cents in Sy.No.314/P of Kapuluppada Village is handed over to VUDA for safe custody.

It is evident from the above that the land is presently in the custody of VUDA and the issue relating to grant of house sites to the petitioners is pending consideration with the 2nd respondent. Hence, it is appropriate to direct the 2nd respondent to examine the said request in the light of the

reports received and the policy of the State and take appropriate decision in the matter expeditiously, preferably within three months from the date of receipt of a copy of this order and inform accordingly to the 1st respondent. Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. No order as to costs.
