HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 6559 OF 2017 ORDER:

This writ petition is filed challenging the action of the 4th respondent in trying to evict the petitioner from the subject property though the appeal filed by the petitioner against the orders dated 15.02.2017 passed by the 4th respondent, is pending before the 3rd respondent.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

It is the case of the petitioner that aggrieved by the orders passed by the 4th respondent vide proceedings No.D/11642/2011 dated 15.02.2017, he preferred appeal along with stay petition before the 3rd respondent on 22.02.2017. But without passing any orders on the appeal of the petitioner, the respondents are trying to evict the petitioner from the subject property.

In view of the same, the 3rd respondent is directed to dispose of the appeal filed by the petitioner on 22.02.2017, after issuing notice to the petitioner, in accordance with law. Till passing of final orders by the 3rd respondent, the impugned proceedings of the 4th respondent dated 15.02.2017 are suspended.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
