The case of the petitioner is that he was working as Mandal Parishad Development Officer, MPP, Khanapur of Warangal District and he was suspended vide proceedings dated 06-03-2017 pending enquiry w.e.f. 11-01-2017 on ground that he was arrested and in custody for more than
(48) hours. The petitioner made a representation on 21-05-2017 to the 2nd respondent for revoking suspension and reinstatement into service. The 1st respondent vide memo directed the 2nd respondent to send a detailed report.
According to G.O.Ms.No.86, General Administration (Ser.C) Department, dated 08-03-1994 suspension against Government Servants shall be reviewed at the end of every six months. Aggrieved by the action of respondents in not reviewing the order of suspension passed against the petitioner in terms of G.O.Ms.No.86, dated 08-03-1994, the present writ petition is filed.
Heard both sides.
In view of the above facts and circumstances of the case, the 2nd respondent is directed to undertake review in terms of G.O.Ms.No.86, dated 08-03-1994 and pass orders in accordance with law and thereafter take action within a
period of four weeks from the date of receipt of a copy of this order.
