THE HONOURABLE SRI JUSTICE A.SANTHOSH REDDY CRIMINAL PETITION NO.3850 OF 2023 O R D E R:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioners/Accused Nos.1 & 3 in the event of their arrest in connection with Crime No.125 of 2023 on the file of Station House Officer, Saifabad Police Station, Hyderabad registered for the offences under Sections 420, 468, 471, 120 b read with 34 of Indian Penal Code. 2.
Heard the learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

Learned counsel for the petitioners submits that the petitioners are innocents and they are falsely implicated in this case.

Learned Additional Public Prosecutor submits that fake bills were submitted by the petitioners and for claiming C.M. Relief Fund.

The case of prosecution is that the Section Officer (FAC), Revenue Department, TS Secretariat, Hyderabad lodged a
complaint with the police alleging that the petitioners/ accused Nos.1 and 3 along with accused Nos.2 and 4 have submitted fake bills for claiming C.M. Relief fund. On verification, they found that the bills submitted the petitioners and others to claim money were fake. The petitioners/accused Nos.1 and 3 have conspired together to take advantage of funds of C.M.Relief Funds. On such complaint, a case in Crime No.125 of 2023 was registered by police under Sections 420, 468, 471, 120 (b) read with Section 34 of Indian Penal Code.

Having heard learned counsel for the petitioners that the petitioners/Accused Nos.1 and 3 are innocent and ladies and also that Accused No.1 is having a small baby, I am inclined to allow the petition and the petitioners/Accused Nos.1 and 3 shall be enlarged on bail in the event of their arrest subject to the following conditions:
i) The petitioners/Accused Nos.1 and 3 are directed to surrender before the Station House Officer, Saifabad, Hyderabad within two weeks from the date of receipt of a copy of this order. On such surrender, they shall be enlarged on bail on their executing personal bonds for a
sum of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties in a like sum each, to his satisfaction. ii) The petitioners/Accused Nos.1 and 3 shall appear before the investigating authorities as and when required for the purpose of investigation.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
