THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2642 OF 2022 O R D E R:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioners/Accused Nos.1 to 3 in the event of their arrest in connection with Crime No.288 of 2022 of Rajendranagar Police Station, Cyberabad registered for the offence punishable under Section 498-A of Indian Penal Code, 1860 (I.P.C.) and Sections 3 and 4 of Dowry Prohibition Act (DP Act) 2.
Heard the learned counsel for the petitioners, learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioners are arrayed Accused Nos.1 to 3 in the aforementioned crime. The de facto complainant lodged a complaint on 14.02.2022 before the police stating that she was married to the 1st petitioner on 22.06.2021 and as demanded dowry was given, thereafter, the petitioners harassed the de facto complainant after she joined the petitioners in Uttar Pradesh, unable to bear the harassment which was physical and oral, the de facto complainant
left the house of the petitioners, came to her parents house and filed the present complaint.

The learned counsel for the petitioners submits that no such harassment was meted out to the de facto complainant and now that she did not intend to stay with the petitioners in Uttar Pradesh came to Hyderabad and filed false complaint.

However, the offences alleged against the petitioners are punishable upto seven years and the petitioners undertake to appear before the concerned police as and when required and make themselves available for investigation.

Accordingly, the Criminal Petition is allowed subject to the following terms and conditions:
i) The petitioners/Accused Nos.1 to 3 are directed to surrender before the Station House Officer, Rajendranagar, within a period of one week from today, and on such surrender, the said Station House Officer shall release the petitioners/Accused Nos.1 to 3 on bail on their executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with two sureties to the like sum each to his satisfaction
ii) The petitioners/Accused shall appear before the Investigating Officer on 10.04.2022, 11.04.2022 and 15.05.2022. Thereafter whenever the petitioners are required for the purpose of investigation, the petitioners shall make themselves available to the Investigating Officer.
iii) The petitioners shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

Miscellaneous petitions pending, if any, shall stand disposed of.
