THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL REVISION CASE No.137 of 2013 ORDER:

This Criminal Revision Case is filed against the orders of the learned IX Special Magistrate, R.R.District at Hasthinapuram, Hyderabad, dated 23.11.2012 in

Crl.MP.No.1463 of 2012 in C.C.No.161 of 2012.

2. Heard the learned counsel appearing for the revision petitioner and the learned Additional Public Prosecutor, representing the State.

3. The revision petitioner is the de facto complainant and the 1st respondent is the accused. The case involves the offence alleged to have been committed by the accused under Section 138 of Negotiable Instruments Act. The cheque in question admittedly when sent to ICICI Bank, Nalgonda, the same has been returned dishonoured on 05.12.2011. The Court of IX Special Magistrate, Ranga Reddy District at Hasthinapuram, Hyderabad has no jurisdiction to entertain the complaint. Therefore, the Court below rightly allowed the petition filed by the accused and properly returned the complaint for being presented in proper Court. 4 . I see no merit in the present criminal revision case and the same is accordingly dismissed.

Pending miscellaneous applications, if any, shall stand closed in consequence.
