Crl.Petition No.2652 of 2022 THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2652 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner/Accused No.1 in the event of his arrest in connection with C.C.No.9038 of 2020 on the file of XIII Additional Chief Metropolitan Magistrate at Hyderabad.

Heard the learned counsel for the petitioner, learned Assistant Public Prosecutor and perused the record.

The petitioner is arrayed as Accused No.1 in Crime No.820 of 2019 for the offences under Sections 498-A and 406 of IPC and Sections 4 and 6 of Dowry Prohibition Act. The said crime was investigated and charge sheet filed by WPS, CCS, Hyderabad vide C.C.No.9038 of 2020 before the XIII Additional Chief Metropolitan Magistrate at Hyderabad.

Learned counsel for the petitioner submits that the petitioner/Accused No.1 undertakes to appear before the trial Court which is XIII Additional Chief Metropolitan Magistrate at Hyderabad on 18.04.2022.

In the said circumstances, this Court is inclined to grant anticipatory bail to the petitioner/Accused No.1 herein. 6.

Accordingly, the Criminal Petition is allowed subject to the following conditions:

i) The petitioner/Accused No.1 is directed to surrender before the XIII Additional Chief Metropolitan Magistrate at Hyderabad on 18.04.2022, and on such surrender, the said XIII Additional Chief Metropolitan Magistrate at Hyderabad shall release the petitioner on bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with two sureties to the like sum each to his satisfaction.

ii) The petitioner/Accused No.1 shall appear before the trial Court as and when directed without delaying the process of trial. 7.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
