THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4845 of 2017 ORDER:

This Writ Petition is filed questioning the auction that has been conducted by the respondents, with respect to the land an extent of Ac.7-30 gts., situated in Sy.Nos.24, 25 and 26 of Uppuguda, Hyderabad, belonging to the 5th respondent temple, on the ground that there was no permission granted by this Court in terms of the Public Interest Litigation as well as that there was no procedure followed.

Sri Kotha Jagan Mohan Reddy, Learned Standing Counsel for the 5th respondent, had placed on record the order passed on 24.10.2008 in W.A.M.P.No.2325 of 2008 in W.A. No.514 of 2008, wherein a Division Bench of this Court permitted sale of the property through public auction.

As the ground on which the Writ Petition was challenged is not available, learned counsel for the petitioners seeks liberty to withdraw the Writ Petition with liberty to take appropriate steps. Accordingly, this Writ Petition is dismissed as withdrawn, giving liberty to the petitioners as prayed for. No costs.
