HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CIVIL REVISION PETITION No. 1794 of 2018 ORDER:

The present application came to be filed questioning the order dated 28th February, 2018 in I.A.No. 1273 of 2017 in O.S.No. 76 of 2014, wherein the application filed by the G.P.A. holder of the plaintiff in the suit, to permit her to give evidence as PW1 on behalf of the plaintiff, was dismissed. The only ground on which the application came to be dismissed was that the affidavit which has been filed in support of the application does not indicate subsistence of the Power of Attorney as on that date. 2.

The learned counsel for the petitioner submits that due to inadvertence, the fact of subsistence of the Power of Attorney was not mentioned in the affidavit filed before the trial court, and that the Power of Attorney exists/ subsists even as on today. 3.

Having regard to the above, the C.R.P is disposed of, permitting the petitioner to file all the necessary documents before the trial court, along with an affidavit disclosing all facts, in which event, the same shall be dealt with in accordance with law, at the earliest. Miscellaneous petitions pending, if any, stand closed.
