Order:

At the interlocutory stage, the Writ Petition is taken up for hearing and disposal.

This Writ Petition is filed with the grievance that respondent No.2 has not been taking action against respondent No.4 for the alleged irregularities committed by him in running the fair price shop of Kothapalli Village, Kambadur Mandal, Anantapur District. Neither the official respondents nor respondent No.4/caveator, have filed counter-affidavits.

Considering the innocuous grievance of the petitioner, respondent No.2 is directed to consider the representation, dated 18-04-2011, stated to have been made by the petitioner and other cardholders attached to the fair price shop in question, and initiate appropriate action against respondent No.4, in the event he is prima facie satisfied that the allegations require a detailed enquiry. In the event respondent No.2 does not propose to hold an enquiry, he shall pass appropriate order giving reasons therefor and communicate the same to the petitioner within one month from the date of receipt of this order.

Subject to the above directions, the Writ Petition is disposed of. As a sequel to disposal of the Writ Petition, WPMP.No.20674 of 2011, filed by the petitioner for interim relief, is disposed of as infructuous.
