THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.8026 OF 2017 ORDER:

Heard learned counsel for the petitioner/accused of Crime No.156 of 2017 on the file of Bayyaram Police Station, Mahabubabad District, registered for the offences punishable under Sections 294(b), 468, 471 and 506 IPC and also heard the learned public prosecutor, representing for the 1st respondent - State, before ordering notice to the 2nd respondent and perused the grounds urged in the quash petition and FIR and other material on record. 2.

There is nothing for this Court to interdict the investigation from perusal of the FIR contents. Having regard to the above, this criminal petition is disposed of, by making it clear that in the event of any necessity of arrest of the petitioner, the police shall strictly follow Section 41A of Cr.P.C. and the guidelines laid down by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
