HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 34101 of 2016 Order:
The petitioner was appointed as Secondary Grade Teacher and posted at P.S. Nagireddypally Mandal Parishad, Siddipet Mandal, through proceedings dated 12.11.2000. Later on, he was promoted as School Assistant after conducting counselling. He was posted to UPS Narsapur, Siddipet Mandal, by proceedings dated 19.07.2015, but the same was cancelled in order to rectify the omission after verification of the record and an order was passed on 23.07.2015 posting him at ZPHS, Madoor, Shankarampet-R Mandal as per his option. After joining there, he submitted an application on 12.09.2016 stating that from his native village to Madoor village is 70 KMs and he has to assist his aged mother. He further states that there is vacancy in the ZPHS, Essanpalli, Siddipet Mandal and his case should be considered for posting in the said place.
When the same was not considered, the present Writ Petition is filed. Learned counsel for the petitioner submits that though the petitioner initially was posted in UPS, Narsapur, the same was cancelled for the reasons best known to the respondents and he is posted at ZPHS, Madoor, Shankarampet-R Mandal without exercising any option. But, after perusing the record this Court is not satisfied with the said submission.
Learned Government Pleader submits that the application filed by the petitioner on 12.09.2016 was addressed to the second respondent who cannot transfer any Teacher on his own unless there are specific orders from the Government.
In the circumstances, without expressing any opinion on the merits of the case, the second respondent is directed to consider the application submitted by the petitioner dated 12.09.2016 and pass appropriate orders thereon in accordance with law within a period of three (3) months from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. The miscellaneous petitions pending, if any, shall stand closed.
