THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TRANSFER C.M.P. No.908 of 2016 ORDER:

This transfer civil miscellaneous petition is filed under Section 24 of CPC seeking to withdraw F.C.O.P.No.205 of 2016 from the file of the Family Court, Ranga Reddy District at L.B. Nagar and transfer the same to the Family Court, Rajahmundry. 2.

The learned counsel for the respondent submitted that the petitioner herein remained ex parte in F.C.O.P. No.205 of 2016. He further submitted that the petitioner herein filed I.A. No.334 of 2017 to set aside the ex parte order dated 01.10.2016. The learned counsel for the petitioner submitted that he is not aware of the I.A. Number filed by the petitioner to set aside the ex parte order.

Having regard to the facts and circumstances of the case, the trial court is hereby directed to dispose of the ex parte set aside petition i.e., I.A. No.334 of 2017 in accordance with law, after affording reasonable opportunity to both parties. 4.

With the above direction, the Transfer CMP is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
