HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 21224 of 2016 Order:

The first petitioner is the mother and the second petitioner is the son. The first petitioner states that her elder son namely Ragi Veerendra Kumar was appointed as Badli Coal filler at 5 Shaft Mine on 11.05.1995 and while in service he died on 20.06.2007. As on the date of death he was unmarried. In spite of several visits to the respondents, the terminal benefits due to the said Veerendra Kumar were not paid to the first petitioner. Now the first petitioner states that her younger son who is the second petitioner herein is a graduate and he is eligible for being appointed on compassionate grounds. When the terminal benefits and the appointment of the second petitioner were not considered the first petitioner submitted a representation on 03.04.2016. When the said representation was not considered and appropriate orders were not passed, the present Writ Petition is filed.

2. Even though, notice before admission was ordered and the case is posted after four weeks, when the matter is taken up today, there is no response from the respondents.

3. In the circumstances, without going into the merits of the case, this Writ Petition is disposed of with a direction to the respondents to consider the representation of the first petitioner dated 03.04.2016 and pass appropriate orders thereon in accordance with law within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
