HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20716 of 2010 ORDER:

This Writ Petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to declare the action of the 1st respondent in not taking action against the 2nd respondent and his interfering from the civil dispute with the collusion of the 3rd respondent in vacating the petitioner from the shop bearing Door No.9C/ 22, Ground floor, Rayadurg Road, Kalyandurg, Anantapur District, as illegal and arbitrary. The case of the petitioner is that he is running a medical shop by taking the premises of the 3rd respondent on rent and his licence for the medical shop was renewed from 20.06.2007 to 20.06.2012 and that the 3rd respondent also agreed to give the shop to the petitioner till his licence period expires. Thereafter, the 3rd respondent is trying to evict the petitioner from the said shop, though the petitioner is paying the rents regularly.

Heard and perused the material available on record. On 27.08.2010 while admitting the writ petition, this Court passed an interim order in WPMP No.26358 of 2010 directing respondent Nos.1 and 2 not to take steps against the petitioner for evicting him from the subject shop except in accordance with law, pending further orders. Considering the facts and circumstances of the case and since the matter pertains to the year 2010, the writ petition is disposed of making the interim order passed by this Court on 27.08.2010 in W.P.M.P.No.26358 of 2010 as absolute. There shall be no order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. ______________ RAJA ELANGO, J August 07, 2017 KTL
