ORDER:

The petitioner assails the order passed by the Court of Principal Junior Civil Judge, Kadiri, in I.A.No.47 of 2014 in O.S.No.203 of 2007, dated 27.10.2015. The plaintiff filed the said I.A. praying to implead the 7th respondent in the said I.A. as 7th defendant in the suit and having regard to the issue involved in the suit, the trial Court allowed the application.

2. Learned counsel for the petitioner seeks to contend that the petitioner is no way concerned with the prayer sought in the suit and, therefore, the petitioner was unnecessarily arrayed as a respondent. Admittedly, the petitioner is the purchaser of Item No.2 of the suit scheduled properties.

3. Whether such a purchase was made prior to the initiation of the suit or after the initiation of the suit is the matter for consideration in the suit. Therefore, no opinion can be expressed at this stage on that claim of the petitioner.

4. Having regard to the facts of this case, I do not see any error committed by the Court below warranting interference. The Civil Revision Petition is, accordingly, dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this civil revision petition shall stand closed.
