THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 764 OF 2018 O R D E R :

This Contempt Case is filed alleging violation of the order dated 03.10.2017 in Writ Petition No. 32874 of 2017. 2.

Considering the limited prayer of the petitioners for payment of remuneration in terms of G.O.Rt. No. 9, dated 12.02.2014, this Court, while giving them the liberty to approach Respondents 2 and 3 therein, disposed of the Writ Petition. 3.

In this case, a counter-affidavit is filed by the Director, Juvenile Welfare Correctional Services & Welfare of Street Children, the 2nd respondent in the Writ Petition, categorically stating that G.O.Rt. No.9, dated 31.01.2017 was issued according administrative sanction for payment of enhanced sitting / meeting allowances to the Chairperson & Members of Child Welfare Committees and Social Worker Members of Juvenile Justice Boards at Rs.1,000/- with effect from 31.01.2017, as the said G.O. has prospective effect. It is further stated that the representation of the petitioners came to be considered and disposed of vide order dated 18.03.2018.

In view of the categorical averments in the counter-affidavit, if the petitioners aggrieved with G.O.Rt.No. 9, the contempt proceedings is not proper remedy and that they are required to take steps in accordance with law. Further, the argument of the

learned counsel for the petitioners that the said G.O. is applicable retrospectively also cannot be considered in the Contempt Case. 5.

In those circumstances, the Contempt Case is closed. Miscellaneous petitions, if any, pending in this Contempt Case shall stand closed.
