O R D E R

This writ petition was filed assailing the action of the Station House Officer, I Town Police Station, Anantapur, in continuing a rowdy sheet against the petitioner on the file of the said police station. The Sub-Inspector of Police, Anantapur I Town Police Station, filed a counter-affidavit stating that earlier the petitioner was involved in certain criminal cases. However, the details furnished reflect that the petitioner was acquitted in Sessions Case No.154 of 1998 by the learned Additional Sessions Judge, Hindupur, Anantapur District, which related to Crime No.62 of 1994 and he was also acquitted in Sessions Case No.302 of 1988 by the learned District and Sessions Judge, Anantapur, which related to Crime No.10 of 1988. Further, he was bound over for good behaviour in relation to Crime Nos.64 to 66 of 1997 and Crime No.79 of 2009.

It is therefore manifest that the petitioner was not involved in any criminal case since the year 2009. The rowdy sheet which was opened against him in December, 1996, is still being continued notwithstanding this fact. Further, the Sub-Inspector of Police himself stated that the petitioner is presently 63 years of age.

In that view of the matter, the continued maintaining of a rowdy sheet against the petitioner at this stage of his life, all the more so in the absence of any criminal activity, cannot be sustained. The respondents are therefore directed to close the rowdy sheet opened against the petitioner.

The writ petition is accordingly allowed.

Pending miscellaneous petitions shall stand closed in the light of this final order.

No order as to costs.
