HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.8487 of 2018 ORDER:

Heard learned counsel for the petitioners, learned Government Pleaders for Fisheries and Revenue for the respective respondent Nos.1 to 4 respectively before ordering notice to respondent No.5 and perused the prayer in the writ petition with supporting affidavit and the other material on record. 2.

The prayer in the writ petition reads as follows: " ........to issue Writ, Order or direction more particularly one in the nature of Writ of Mandamus by declaring the inaction of the Respondent Authorities in enrolling the petitioners as members in the Munugode Fisherman Co-operative Society as illegal, arbitrary, in violation of Article 19(1)(c) of the Constitution of India and also against the principles of natural justice and Andhra Pradesh Cooperative Societies Act, 1964 and to consequentially direct the Respondent authorities to enrol the petitioners as members of the society and to pass such other order or orders may deem fit and proper........."

It is the supporting affidavit averments vis-à-vis oral submissions of the learned counsel for the petitioners that despite they applied for the membership in respondent No.5-Primary Fisherman Co-operative Society, Munugode, no action so far taken by the official respondents, particularly, respondent No.3-District Fisheries Officer, Nalgonda District, within whose jurisdiction respondent No.5-Society is situated.

It is the submission of the learned Government Pleader for Fisheries that the Authorities will consider the representation of the petitioners and pass appropriate orders, after hearing, on merits.

Recording the above submissions, this Writ Petition is disposed of, directing respondent Nos.1 to 4 to consider the representation of the petitioners pending for membership of respondent No.5-Society and pass appropriate orders after hearing and communicate the same to the petitioners within six weeks from the date of receipt of copy of this order. 6.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
