Petitioner challenges Notification No.45/ SEC-B1/ 2016-13 dated 18.10.2016 issued for conducting election of President, Mandal Praja Parishad, Gopalapuram Mandal without filling up the casual vacancy of MPTC, Chityala, West Godavari District as illegal, arbitrary and contrary to the Panchayat Raj Act.

The election was scheduled to be held on 28.10.2016 and for reasons within the knowledge of respondents, the election was postponed to 29.10.2016, the same reasons continued and as on date, the election for the post of President of Mandal Praja Parishad is not scheduled. The complaint of the petitioner is that respondents ought to take up required steps for filling up the causal vacancy of MPTC, Chityala and thereafter, take steps for conducting election for the post of President of Mandal Praja Parishad, Gopalapuram Mandal. 4.

As the election scheduled to be held on 28.10.2016 is postponed, to give opportunity to MPTC, Chityala as well, in electing

President, Mandal Praja Parishad, this Court is of the view the writ petition can be disposed of by this order:

Respondents 2 and 3 are directed to initiate steps for conducting election to casual vacancy of MPTC, Chityala and complete the same, preferably, within two (2) months from the date of receipt of copy of this order. Thereafter, take up election for President, Mandal Praja Parishad, Gopalapuram Mandal.

As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs. ____________ S. V. BHATT, J November 16, 2016 DSK
