HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24822 OF 2017 ORDER:

This writ petition is filed challenging the proceedings dated 10.03.2017 vide Ref.No.2213/2014-S3, whereby the request of the petitioner for promotion to the post of Forest Section Officer for the panel year 2016-2017 was rejected on the ground that the petitioner was imposed punishment of stoppage of one annual grade increment without cumulative effect, which was came into effect from 01.04.2016 to 31.03.2017.

Learned counsel for the petitioner submits that though punishment came into effect from 01.04.2016 to 31.03.2017, petitioner is entitled for promotion from 01.04.2017, as the post for which he is seeking promotion is a non-selection post, and that no panel will be prepared for non-selection post. Heard learned Assistant Government Pleader for Services. It is to be seen that admittedly promotion for the post of Forest Section officer is a non selection post, as such, question of preparation of panel does not arise. Even according to the impugned order the effect of punishment imposed on the petitioner ended by 31.03.2017, and petitioner will be entitled for promotion from 01.04.2017.

In view of the same, respondents are directed to consider the case of the petitioner for promotion, in case decision is taken by the respondents for making promotion to the post of Forest Section Officer for the panel year 2016-2017.

Accordingly, the writ petition is disposed of. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand dismissed. ___________________________ A.RAJASHEKER REDDY,J 22-08-2017 tk
