HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.794 of 2015 ORDER:

This petition is filed to withdraw O.P.No.428 of 2015 from the file of Family Court, Secunderabad and transfer the same to Senior Civil Judge, Huzurabad.

2. Wife filed this petition. According to her affidavit, her marriage was performed with respondent on 13.11.2013 and they lived happily for about 4 months and after birth of a female child, her husband started harassing her physically and mentally and due to harassment, she left the marital home and staying at Shankarapatnam Mandal, Karimnagar District at her parents' house. She stated that respondent filed O.P.No.428 of 2015 for dissolution of marriage and for divorce at Secunderabad and that there is no direct transport from Kothagattu village to Secunderabad and that she is a poor person and she is completely dependent on her parents and her father was working as Attender in a private school and not in a position to spend money for her travelling expenses from Kothagattu village to Secunderabad, for these reasons, she prayed for transfer of O.P.No.428 of 2015 from Family court, Secunderabad to Senior Civil Judge, Huzurabad.

3. Respondent has not filed any counter.

5. Advocate for respondent submitted that respondent has no objection for transfer of O.P. from Secunderabad to Huzurabad.

6. Considering the reasons stated in the affidavit and also considering the no objection from advocate for respondent,

O.P.No.428 of 2015 is withdrawn from the file of Family Court, Secunderabad and transferred to Senior Civil Judge, Huzurabad for disposal in accordance with law.

7. Accordingly, the Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
